These Terms form an agreement between you and Intigr8 Inc. ("Intigr8," "we," "us," "our"), the operator of the gr8beyond platform (the "Service" or "gr8beyond"). gr8beyond is a product of Intigr8 Inc.

1. Acceptance of These Terms
By accessing or registering for the Service, you agree to be bound by these Terms and by our Privacy Policy and, where applicable, the standalone Legacy AI Consent Form. If you do not agree, do not use the Service.
You represent that you are at least 18 years old and legally competent to enter this agreement.
2. What the Service Is — and Is Not
2.1 What it is. gr8beyond is a digital pre-planning and legacy platform that lets you create and maintain a personal Legacy Profile and, with separate consent, a Legacy AI — an interactive, AI-based digital representation of a person (see Section 4).
2.2 What it is not. The Service is not a funeral, cremation, or memorial contract, and we are not a licensed funeral provider. Actual arrangements are made through a licensed funeral provider of your choosing.
3. Your Account & Representations
3.1 Truthful information. You represent that information and content you provide is truthful and that you have the right to provide it.
3.2 Registering for someone else. You may register on behalf of another person (the "Individual") only if you are their spouse, legal guardian, personal representative, or hold a power of attorney, and you have authority to make the consents described in these Terms on their behalf. You agree to indemnify us (Section 11) against any claim that you lacked that authority.
3.3 Account security. Keep your credentials confidential; you are responsible for activity under your account.
4. Legacy AI
4.1 What it is. A "Legacy AI" is an interactive, AI-generated digital representation of the Individual that may reproduce or simulate their audio (including voice), video, image, likeness, and personality, built from data collected through the Service. A Legacy AI is an interpretation, not the person — it does not reproduce the Individual's actual thoughts, views, or statements.
4.2 Separate consent required. A Legacy AI is created only if you (or the Individual) complete the standalone Legacy AI Consent Form. That consent is voluntary and is not a condition of using gr8beyond. The form describes exactly what is collected, how it is used, and how it can be revoked.
4.3 Rights after death. The Legacy AI consent and license survive the Individual's death and remain in full effect until revoked by the Individual's Legal Next of Kin (executor → surviving spouse → adult children → parents → adult siblings, in that order). Death alone does not deactivate a Legacy AI.
4.4 No AI at funeral services. Funeral providers working with the Individual's Legacy Profile may display only original, real recordings (photos, writings, audio, and video actually recorded by or of the Individual). The Legacy AI — or any AI-generated likeness, voice, or video — may not be presented at a funeral, memorial, or celebration-of-life service.
4.5 Visibility. A Legacy AI is not public by default. It is accessible only to the Individual and their designated family unless the Individual (while living) or the Legal Next of Kin (after death) authorizes public access.
4.6 No warranty on outputs. We make no representation or warranty about the accuracy, completeness, or reliability of any Legacy AI output, and no representation that it reflects the Individual's actual views. Legacy AI outputs are identified as AI-generated.
5. Your Content and Data
5.1 You own your content, subject to the licenses below.
5.2 License to us. You grant Intigr8 a worldwide, royalty-free license to host, store, process, reproduce, adapt, and use the content and data you provide — to operate, maintain, improve, and develop the Service and the Legacy AI (if consented). This license survives your death / the Individual's death and continues until revoked by the Individual (while living) or the Legal Next of Kin (after death). See the Privacy Policy for details.
5.3 No selling of personal data. We do not sell your personal information. See the Privacy Policy.
5.4 Designated Funeral Provider. If you consent on the Legacy AI Consent Form, we may — after verified confirmation of death — grant the funeral provider you designated (which may be pre-filled from your referral source) access to the Individual's Legacy Profile solely to plan and deliver a personalized service, with the real-recordings-only limits in 4.4. Providers may not use that information for marketing or any other purpose.
5.5 Content rules. You may not upload content that is unlawful, infringing, or that features third parties without their consent, and you may not use the Service to create a digital representation of any person without valid legal authority.
6. Prohibited Uses
You may not: (a) misuse, probe, or disrupt the Service; (b) scrape or reverse-engineer it; (c) impersonate any person; (d) use any Legacy AI or output for harassment, defamation, or commercial exploitation of a person's likeness; or (e) assist others in doing any of the above.
7. Intellectual Property
The Service, its software, design, and brand belong to Intigr8 Inc. Your licenses under these Terms do not transfer ownership to you, and ours under 5.2 do not transfer ownership of your content to us.
8. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that any Legacy AI output will be accurate or appropriate.
9. Limitation of Liability
To the maximum extent permitted by law, Intigr8 is not liable for indirect, incidental, special, or consequential damages, and our total liability is limited to the greater of the amount you paid us (if anything) or $100.
10. AI Outputs
Legacy AI outputs are AI-generated, interpretive, and labeled as such. You are responsible for how you use or share any output.
11. Indemnification
You agree to hold Intigr8, its officers, employees, and representatives harmless from claims, damages, and expenses arising from: (a) your breach of these Terms; (b) your content or lack of authority to provide it; or (c) claims by an Individual, their heirs, estate, or family relating to a Legacy AI — except to the extent arising from our violation of applicable law.
12. Termination & Survival
12.1 You may delete your account at any time while living; after death, the Legal Next of Kin may request deletion.
12.2 We may suspend or terminate accounts that violate these Terms.
12.3 Sections 3–11 survive termination, including the Legacy AI licenses (subject to revocation per the Consent Form) and the survive-until-revoked rule in 4.3.
13. Changes to These Terms
We may update these Terms and will post the current version at gr8beyond.com/legal with an updated date. Material changes to Legacy AI consents apply only prospectively and require fresh consent.
14. Governing Law & Disputes
Governing law: State of [STATE], without regard to conflict-of-laws rules. Disputes are resolved by binding arbitration, with small-claims exceptions.
